Your privacy on the Internet is important to us. As the Internet offers the ability to collect certain information about users, we want you to understand the terms and conditions surrounding the capture and use of information we gather. This privacy statement discloses what information we gather, how we use it, and how to correct or change it.
Personal Information
Personal information under New Zealand's Privacy Act 2020 is defined very broadly as "information about an identifiable individual," and this includes data that is commonly collected and processed by third-party trackers and cookies used by social media platforms (e.g., via a like button on your domain) or marketing services (e.g., advertisements on a website).
Because coaching and hypnotherapy support can involve information about your mental wellbeing, some of the information we collect is also covered by the Health Information Privacy Code 2020, which sits alongside the Privacy Act 2020 and sets additional rules for how health information is collected, stored, and used.
Collection
This website, managed by Tony Yuile ("TY"), may gather two types of information about users, including you ("you"):
- Personal information, provided by you at the time of voluntary registration for the services we offer or surveys you are asked to participate in; and
- Aggregated information generated by our systems or third-party systems we use, which tracks traffic to our sites but does not identify you personally.
Failure to provide necessary personal information when requested may result in certain services not being available to you.
Client Information is Stored in Quenza
When you become a client, you will be asked to create a client account in Quenza (https://quenza.com/), a client management platform.
All documentation and written correspondence between TY and you are managed in Quenza, a third-party application designed to make the interaction between the coach and their clients as safe and secure as technically possible.
All data is stored in Quenza with industry-leading AES-256 encryption.
Quenza is fully HIPAA and GDPR compliant.
Quenza is designed according to the latest Privacy by Design standards.
Overseas Storage: Quenza's servers may store or process your information outside New Zealand. Under the Privacy Act 2020, we've taken reasonable steps to confirm Quenza maintains privacy and security safeguards comparable to those required under New Zealand law before using it to hold client information.
Retention: Client notes and records are retained for 10 years, in line with standard practice for health and therapeutic records in New Zealand, after which they are securely deleted.
Disclosure of Information
TY will not disclose your information to any third parties except:
- Aggregated tracking information and other information that does not personally identify you, to third parties such as Meta (Facebook) whose tools we use for analytics and advertising.
- Your personal information to third parties when we believe in good faith that we are required to do so by law.
- Your personal information to third parties provided we have your prior authorisation, which we will usually obtain at the time of collecting the information from you.
Use
We use the personal information we collect:
- To assist in providing the services requested by you.
- To provide further information to you about other services we offer which we consider may be of interest to you.
- For marketing, promotional, and publicity purposes, including email marketing, market research, and surveys — always in line with the Unsolicited Electronic Messages Act 2007, meaning marketing emails require your consent and always include an option to unsubscribe.
- For ensuring that you are shown information that is most relevant to you and your interests.
- For any other uses that you authorise.
Cookies and Tracking
We may use a cookie file containing information that can identify the device from which you are working. This may include details such as your IP address, browser type and version, and general location (e.g., whether you are accessing the site from NZ or elsewhere). We may use the information generated by cookies to:
- Track traffic patterns to and from our site, including which pages you visit, the time you spend on each page, the date and time of your visit, and referring pages.
- Ensure advertising is being shown to the most appropriate person and limit the frequency of display for certain ad formats.
- Enable you to enter our sites and use certain services as a member without having to log on each time, and to visit member-restricted areas of the site.
You can choose to refuse cookies by turning them off in your browser and/or deleting them from your hard drive. You do not need to have cookies turned on to use our websites, but you may need them for customisable areas of the site that we may develop in the future. If your cookies are turned off, we will not have any control over the frequency of display of certain ad formats, which could affect your reading experience.
Children's Information
Our services are intended for adults. Where an appointment involves a person under 16, written consent from a parent or guardian is required, and any personal information collected about a minor is handled with the same care and confidentiality as set out in this policy.
Opting In and Opting Out
If our intended collection, use, or disclosure of your personal information falls outside what's set out in this Privacy Policy, we will give you the option to:
- Opt out and not receive certain services or participate in certain interactive areas; or
- Opt in — for example, agreeing to be contacted by us regarding new services or features, or promotional activities.
Changes to This Policy
We reserve the right to change this policy at any time by updating this page. It's your responsibility to check this page periodically for changes.
Holding, Correcting and Updating Your Information
Under the Privacy Act 2020, you have the right to access and request correction of personal information that we hold about you. We aim to respond to any access or correction request within 20 working days.
If you're unhappy with how we've handled your personal information, or with our response to an access or correction request, you also have the right to make a complaint to the Office of the Privacy Commissioner (privacy.org.nz).
