1. Introduction & Acceptance
Welcome to the website and practice of Tony Yuile T/A TYCoaching ("we," "us," or "our"). This website is operated by Tony Yuile trading as TYCoaching. Throughout the site, the terms "we", "us" and "our" refer to TYCoaching. By using our website and engaging with our services, you agree to the following terms and conditions. We reserve the right to modify these terms and conditions at any time. It is your responsibility to check this page periodically for changes. Your continued use of our services following the posting of any changes constitutes acceptance of those changes.
These Terms are governed by the laws of New Zealand.
2. Nature of Services (Medical Disclaimer)
The information on this website is provided for general educational purposes and does not constitute medical advice, counselling, or an endorsement of any treatment or therapy. It does not substitute for the advice of your healthcare provider. If you suspect you have a health problem, please seek professional medical help.
Not Medical Advice: You acknowledge that Tony Yuile is a Clinical Hypnotherapist and Life Coach, not a Medical Doctor, Psychiatrist, or Psychologist. The services provided (including Hypnotherapy, NLP, IEMT, and Coaching) are complementary and are not a replacement for medical treatment, diagnosis, or prescription medication.
Consult Your GP: If you are experiencing a diagnosed mental health condition, you agree to consult with your General Practitioner (GP) or a mental health specialist regarding your condition before commencing this programme.
No Guarantees: While the Nervous System Coaching Program is evidence-informed and tailored to assist you, specific results vary from person to person. Under the Consumer Guarantees Act 1993, we guarantee our services will be provided with reasonable care and skill, but we cannot guarantee a specific outcome.
3. Programme Investment, Appointments & Cancellations
Agreement and Consent: Before your initial hypnotherapy or coaching session, a signed agreement of your consent to participate is required.
Payment Terms: The Nervous System Coaching Program is offered as a 3-session programme for a total investment of $599 NZD. This begins with a 30-minute Meet & Ask call ($49 NZD), which is deducted in full from your $599 investment should you decide to enrol. Additional sessions beyond the core programme are available at $175 NZD each. The full programme price is payable in three equal instalments over the course of the programme, unless a payment plan has been agreed in writing.
Cancellations & Missed Appointments: Time is reserved specifically for you.
Rescheduling: If you need to reschedule a session, please give at least 48 hours' notice and we will find a new time that works for you.
Late Cancellations & No-Shows: Cancellations made with less than 48 hours' notice, or missed sessions, may not be eligible for rescheduling or refund.
Cancelling the Programme: If you need to cancel the programme altogether before Session 1 has taken place, please get in touch directly to discuss your options.
International Clients: Sessions for clients outside New Zealand are charged in US Dollars (USD) unless otherwise agreed.
4. No Guarantees or Refunds
While we strive to provide effective coaching and hypnotherapy services, we do not guarantee results as these depend largely on individual behaviour and commitment. Hypnotherapy and coaching are not a quick fix or magic solution. They require your active participation and openness to the process. Thus, beyond the cancellation terms set out above, we do not offer refunds for sessions or programmes already delivered.
5. Minors
We require written consent from a parent or guardian for appointments for children under 16.
6. Privacy & Confidentiality (NZ Privacy Act 2020)
We take your privacy seriously and comply with the Privacy Act 2020 and the Health Information Privacy Code 2020. Please read the separate Privacy Policy.
7. Client Rights (Code of Rights)
As a provider of health/disability services in New Zealand, Tony Yuile operates in accordance with the Code of Health and Disability Services Consumers' Rights. You have the right to:
- Be treated with respect.
- Freedom from discrimination, coercion, harassment, and exploitation.
- Dignity and independence.
- Services of an appropriate standard.
- Effective communication.
- Be fully informed.
- Make an informed choice and give informed consent.
- Support.
- Complain.
If you feel your rights have been breached, you may contact the Health and Disability Commissioner (HDC) or the National Council for Hypnotherapy (NCH).
8. Digital Products & Intellectual Property
No-refund policy: TYCoaching provides digital products, including MP3 audio files, PDF resources, and online courses. Because these products are delivered instantly (via download link, email, or account access) and cannot be "returned" in the traditional sense, we operate under a no-refund policy. This policy applies to all purchases made through our website, including but not limited to:
- Digital audio downloads (MP3s)
- PDF guides and workbooks
- Online courses and digital training materials
- Any other downloadable or streaming digital content
Once your purchase is completed and the digital product has been delivered, no refunds, cancellations, or exchanges will be provided. This is standard practice for digital goods, as access cannot be revoked once the file has been delivered.
Faulty or Access Issues: While refunds are not offered, your satisfaction and access to the product do matter. If you experience any of the following, please contact us so we can help:
- You did not receive the download link
- The file is corrupted or will not open
- You cannot access your online course
- There was a technical issue during purchase or delivery
We will work with you to ensure you receive the product you purchased in working order.
Duplicate Purchases: If you accidentally purchase the same digital product more than once, contact us within 7 days at tony@tycoaching.nz. We will verify the duplicate transaction and may offer a remedy such as replacing the duplicate with another product of equal value. We aim to respond within 1–2 business days.
Consumer Rights: Nothing in this policy limits your rights under New Zealand consumer law. If a digital product is not supplied with reasonable care and skill, or does not match its description, you may have rights under the Consumer Guarantees Act 1993.
Copyright: The content of the Nervous System Coaching Program, this website, and all downloadable materials are the intellectual property of Tony Yuile.
Permitted Use: You may use these materials for your personal use only. You may not share, duplicate, resell, or distribute these materials to others without express written permission.
9. Liability & Website Use
Third-Party Links: This website may contain links to third-party sites. Tony Yuile does not endorse or control these sites and accepts no liability for their content or any damage resulting from their use.
Limitation of Liability: To the maximum extent permitted by NZ law, Tony Yuile shall not be liable for any indirect or consequential losses arising from the use of this website or services. Our total liability shall be limited to the amount paid by you for the services.
